Buying Strategy

Buying a North Carolina STR: must you honor future bookings?

A North Carolina short-term rental buyer cannot assume future guest stays disappear when the seller's Airbnb or Vrbo account stops operating. Under the state's Vacation Rental Act, a buyer taking title after a voluntary sale generally takes it subject to qualifying vacation-rental agreements that end no later than 180 days after the deed is recorded. That may commit the buyer to host stays at prices and terms set by the seller. Before signing an offer, get the reservation dates and written agreements, then reconcile advance rent and the platform handoff. Make the purchase work on those obligations—not on an empty-calendar assumption. Book a call to underwrite a North Carolina STR purchase with future bookings.

Apply the North Carolina rule to actual agreements

North Carolina General Statute 42A-4 defines a vacation rental as residential property rented for vacation, leisure, or recreation for fewer than 90 days to a person with a permanent residence to return to; it defines a vacation-rental agreement as a written agreement for that use. Ask a North Carolina attorney to determine which seller bookings qualify. A platform calendar block alone is not proof of a binding agreement, and a business-travel or other excluded stay may need different treatment.

Section 42A-19 says a buyer in a voluntary property transfer takes title subject to qualifying agreements that end no later than 180 days after the buyer's interest is recorded. For an agreement ending later, the guest cannot enforce it against the buyer unless the buyer agrees in writing to honor it; the guest is entitled to the statutory refund route otherwise. Count from deed recording, not listing date, contract date, or a rough closing estimate. The North Carolina Real Estate Commission explains that these stays are material to a purchase transaction. This is not a generic state-name variation of a booking handoff: the statute can bind the buyer even when platform accounts do not transfer.

Demand the booking schedule before the purchase contract

Section 42A-19 requires the seller to disclose, before entering a sale contract, the periods covered by vacation-rental agreements. Request a dated schedule for every stay spanning or following the expected recording date: check-in and checkout, guest agreement, rent and fees, taxes, amounts paid, amount still due, cancellation terms, security deposit, and who currently holds the funds. Reconcile the schedule to platform exports and the rental manager's trust-account report. Ask the seller to identify newly accepted stays and set a contract rule for whether new post-closing reservations may be taken during escrow. The general future-reservations guide handles the broader ledger; this page adds North Carolina's binding-window and statutory handoff tests.

The statute provides a post-transfer information process, including seller delivery of guest identity and agreement information within 10 days, subject to an exception when the buyer retains the seller's rental agent under specified conditions. A financed buyer should not wait until after closing to learn the economics. Ask local counsel to make copies and a reconciled ledger a diligence deliverable before protection ends. Review whether the buyer can legally operate the property after transfer; honoring a guest agreement does not itself establish that an STR permit or HOA permission passes with title. Use the permit-transfer guide for that separate gate.

Reconcile advance rent, deposits, and guest notices

Section 42A-19 generally requires the seller or its agent to transfer advance rent and eligible remaining fees for honored agreements to the buyer within 30 days after transfer; for later-ending agreements the buyer does not agree to honor, the statutory refund route applies. The statute treats security deposits separately under Section 42A-18. The Commission notes that purchase teams commonly account for advance rent through the closing statement and closing attorney, but that is a transaction process to arrange, not a reason to skip the line-by-line reconciliation. Ask the closing attorney and manager to show who holds each payment, any earned manager fee, and any seller reimbursement needed so guest funds and service duties align.

The statute also generally requires the buyer or buyer's agent to give written notice to tenants within 20 days after transfer with the new owner's information and their occupancy or refund rights. A specified exception can apply when the buyer retains the broker who procured the rental agreements. Have counsel assign the notice task in writing; do not assume a platform automated message satisfies it. Separately, coordinate with Airbnb, Vrbo, or the manager under that channel's current rules. A legal obligation attached to the property and a platform reservation-transfer process are different things. The Vrbo handoff and Airbnb handoff guides explain their distinct account issues.

Illustrative only: suppose the deed is recorded and one qualifying agreement ends on day 179 while another ends on day 181. The first falls inside the statutory 180-day window; the second requires a separate decision whether the buyer will agree in writing to honor it or the statutory refund route will be used. A $2,000 guest prepayment in either file is not automatically the buyer's free cash flow. Replace these made-up dates and dollars with the actual agreements, channel payout records, service costs, and local counsel's interpretation before pricing the home.

Turn the legal schedule into an offer decision

Proceed when the agreements are classified, the 180-day obligations can be lawfully fulfilled, advance rent and deposits are reconciled, the manager or platform transition has a workable plan, and the conservative cash case still meets your purchase criteria. Renegotiate when low-priced seller stays, missing prepayments, or manager fees measurably reduce the value advertised as 'booked revenue'; ask counsel for a documented price, credit, escrow, or delivery remedy. Delay under valid protection if the agreement schedule or funds report is missing but obtainable before the deadline. Reject a deal that requires displacing protected guests, assumes funds the seller cannot account for, or depends on a permit or platform transfer that cannot be established.

Have a North Carolina attorney review the statute as currently effective, the actual guest agreements, purchase contract, notices, fund handling, local STR permission, and any platform conflict. Frequently asked questions

Must I honor existing bookings when buying a North Carolina STR?

For qualifying Vacation Rental Act agreements that end no later than 180 days after the buyer's deed is recorded, the buyer generally takes title subject to those agreements. Have North Carolina counsel classify each actual stay.

Is the 180 days measured from offer acceptance or closing?

Section 42A-19 measures from when the buyer's interest is recorded with the register of deeds. Use the actual recording date, not an estimated contract or closing date.

What happens to stays ending more than 180 days after recording?

The guest generally cannot enforce the agreement against the buyer unless the buyer agrees in writing to honor it; the statute provides a refund route otherwise. Counsel should apply the rule to the agreements and funds.

Do Airbnb or Vrbo bookings automatically move to my account?

No platform handoff should be assumed from the real-property statute. Verify each platform's current process separately while planning to satisfy any guest obligations that bind the property.
