When is my EMD actually at risk?

Your earnest-money deposit can be at risk if you default, waive a protection, miss a required deadline or terminate without a contractual right. The signed agreement and applicable law determine the outcome.

Track notice requirements as well as dates. A contingency does not protect you automatically if you fail to exercise it properly. Ask your agent or attorney to confirm your rights before a deadline passes.

What contingencies protect my EMD?

Inspection, financing, appraisal and other negotiated contingencies may provide termination rights, subject to their conditions, deadlines and notice requirements. Protections vary by contract and may have been limited or waived.

Review the actual clauses with your agent or attorney. A concern about the property does not by itself establish a right to cancel or receive your deposit back.

What happens if an inspection issue isn’t resolved before the deadline?

Contact your agent and transaction coordinator before the deadline. Options may include a signed extension, an agreed repair amendment or timely termination if your contract permits it.

A protective termination is still a real contractual notice. Use it only on your agent's or attorney's advice, with your authorization and proper delivery. Continued negotiations do not automatically revive a terminated agreement.

What does signing an extension actually do?

If BOTH parties (buyer and seller) sign an extension it will contractually extend that deadline until the new agreed date. This extension acts as an addendum to the larger contract.

Can I get my EMD back if the appraisal is low?

Possibly, if your signed appraisal contingency applies and you exercise it correctly before its deadline. First consider whether a lower price or another acceptable arrangement can be negotiated.

An appraisal gap provision, waived contingency or missed notice can change your rights. Title may need a signed release or another authorized resolution before returning funds.

What happens if I walk away?

Before terminating, have your agent or attorney confirm the contractual basis, deadline and required notice. If a valid contingency permits cancellation, follow the specified process and obtain the deposit release.

Title may need both parties' release or a legally authorized resolution. Walking away outside your contractual rights can put your deposit at risk and create additional liability.
