STR Compliance and Regulatory Risk
Check address-specific city, county, HOA and permit requirements before purchasing a short-term rental property.
Practical answers for buying and launching a short-term rental with BNB Accelerator. Updated September 30, 2026.
How do you determine whether a specific property is STR compliant?
BNB Accelerator uses a layered review: one team member checks the relevant city or county and any HOA, a second team member reconfirms the findings, and the property is checked again under contract. The review also considers septic capacity and permitted bedroom count where relevant.
Confirm the exact address, intended stay length, permit eligibility and any ownership-transfer requirements. Verbal confirmation is part of the process, but keep the applicable ordinances, recorded restrictions and written responses where available. An existing rental listing does not establish your right to operate.
Who checks city, county and HOA short-term rental rules?
The team performs a preliminary review, a second team member checks the findings, and the property is reviewed again under contract. Ask for the underlying rules and the specific address-level conclusions so your agent or attorney can resolve any ambiguity before your contingency deadlines.
What does it mean if an STR is grandfathered in?
An existing use may be allowed to continue after a rule changes, subject to the jurisdiction's conditions. Grandfathered status may depend on continuous operation, permit renewal, ownership or other facts and may not survive a sale. BNB Accelerator generally avoids sourcing properties that depend on uncertain exceptions.
Can I be grandfathered in if short-term rental rules are changing?
This is entirely dependent on the area, as STR rules fluctuate per jurisdiction and no one rule applies.
What happens if a city is discussing new STR restrictions but has not passed them yet?
This is also entirely dependent on location and jurisdiction, some cities have had a freeze on rulings that have stood for over three years with no movement. If there is doubt, the team will not source from those areas or confirm a property.
Does the seller's existing STR permit automatically transfer to me?
Typically No, the transfer process is entirely area dependent, some allow transfer others don’t. Most commonly you’ll be applying for a new permit once closed.
What happens if a property is legal today but regulations change after I buy it?
Future rule changes can restrict or end rental use, impose new conditions or allow some existing operators to continue. The outcome depends on the adopted rule and any applicable legal protections. Do not assume grandfathered status will protect the property. Evaluate a fallback use and the financial effect of losing STR permission before buying.
How should I think about regulatory risk when comparing two markets?
BNB Accelerator considers regulatory risk in tiers. Purpose-built STR communities with explicit governing documents may offer a clearer operating path than mixed residential communities. Markets with recent rule changes or ambiguous restrictions need closer review.
These are screening categories, not legal guarantees. Review municipal and county rules as well as HOA documents, permit conditions and address-specific restrictions. Local economic reliance on tourism does not prevent future rule changes.
Does being in an STR-compliant neighborhood guarantee that the individual property qualifies?
No. Confirm the exact address, zoning, permit availability, occupancy limits, septic capacity and any recorded or HOA restrictions. The team checks the individual property rather than relying only on a neighborhood's reputation.
