An existing cell-tower or rooftop communications lease can make an STR listing look like two income streams in one purchase. Before offering, establish whether the buyer actually receives the rent entitlement, which documents convey it and when the operator will recognize the new payee. Owning the land, hosting equipment and receiving historical rent are different facts. A seller’s prior cash buyout is not the buyer’s recurring revenue. For a purchase within zero to six months, compare the property with and without supported incoming rent, while local counsel, title professionals, the lender and the operator resolve their respective conditions. Discuss the STR candidate and its separate lease-income evidence before paying an income premium.
Separate the land, site rights and payment entitlement
Make three columns in the purchase file: the real-estate interest being acquired, the communications occupant’s rights to use the site, and the rights to receive payments. A tower visible on the survey proves neither an unencumbered income stream nor authority to change its access. Request the executed lease, amendments, recorded memorandum, assignments, releases, payment ledger and any agreement selling or changing payment rights. Reconcile the seller’s statements with those documents through qualified reviewers.
The Crown Castle property-owner page describes lease buyouts, obtaining lease copies and possible property-sale rights of first refusal. These operator materials establish real document questions, not the entitlement or sale terms of your particular property. Do not adopt promotional payment, tax or closing-time assurances as buyer facts. This primary source was reviewed October 7, 2026.
Ask counsel to identify who holds each right today, what the proposed conveyance transfers, what remains with another party and what conditions must be satisfied. A recorded memorandum may not disclose all financial terms; obtain the governing agreements and amendments. Have title professionals explain proposed coverage and exceptions without treating title insurance as a guarantee of future rent collection.
This is incoming third-party rent, not the buyer’s outgoing ground-lease expense or solar lease/PPA payment. The title packet supplies the broader conveyance review. Keep the narrower rent entitlement and payee decision explicit instead of assuming a general title check resolves it.
Use a rights-and-payee register before accepting the income line
| Evidence row | Question before the protected deadline | Responsible reviewer |
|---|---|---|
| Estate and lease footprint | Which parcel, roof, equipment area and access rights are affected? | Counsel, title and surveyor |
| Complete contract history | Are the signed lease, amendments and payment-related agreements available? | Counsel and seller’s authorized representative |
| Rent entitlement | Who receives which payments, and which rights actually convey? | Counsel and settlement team |
| Payment reconciliation | Do ledger, notices and receipts match the claimed stream? | Buyer’s underwriter and operator |
| Sale conditions | Does a notice, consent, option or right of first refusal affect this transaction? | Local counsel and closing team |
| New payee setup | What evidence, verified channel and effective date does this operator require? | Buyer’s assigned handoff owner |
Write the evidence date, unresolved question and decision deadline beside every row. Ask the operator through an independently verified channel for its current ownership/payee-change process and the correct site identifier. Do not send bank, tax or identity documents to an unsolicited email merely because it includes a lease number. Keep sensitive documents in the agreed secure process; a non-sensitive status memo is enough for an ordinary acquisition call.
Distinguish an operator’s receipt of documents from acceptance of the new payment instructions. Ask who confirms completion, which payment will use the new payee, how misdirected payments are reconciled and what is needed if the buyer’s actual ownership name differs from the seller’s. Processing and payment timing are transaction facts to verify, not a universal number of days promised by this guide.
Have settlement counsel address prorations, prepaid amounts, arrears, disputed adjustments and any agreed seller follow-up separately. A seller’s old bank receipt supports a historical collection only; it does not establish the buyer’s future entitlement. Do not assume a change-of-payee form cures an absent assignment, overrides a buyout agreement or supplies a purchase-contract remedy.
Test the continuing site obligations independently of guest income
Plot the actual lease footprint, access route, parking, utility facilities and proposed STR amenities on the survey. Ask professionals what the documents allow and who may enter the site. A buyer planning to relocate an access drive or add a pool needs a rights review, not just a contractor quote. Do not interfere with equipment or promise a guest-only area that conflicts with an existing right.
Request a responsibility map for maintenance, taxes or reimbursement, utilities, insurance, repair access and emergency contacts as applicable to the actual agreement. Identify obligations that the buyer retains even when another party receives rent. Do not assume the operator pays every site cost, or that a title exception is an operational approval. Insurer acceptance and lawful guest use remain separate gates.
Send the complete package to the proposed lender. Ask whether this income is recognized for qualification or underwriting, how the encumbrance affects collateral and appraisal, and what closing conditions apply. A genuine rent entitlement does not guarantee lender acceptance. Do not count the same payment as both guest revenue and miscellaneous rent, or assume another loan program’s treatment applies.
A tower or rooftop tenant also does not prove good indoor phone reception or an acceptable guest experience. The cell-service field test covers that separate question. Review access, noise, visual impact and guest-use limitations on property evidence without inventing a booking premium or discount.
Worked purchase comparison: supported rent versus no conveyed rent
Original hypothetical arithmetic only, not a client result, market rent, lender calculation, legal finding or valuation recommendation. Suppose independently supported STR owner cash is $8,000 annually after its complete recurring expense stack and full debt payments, excluding the separate communications items below. The seller advertises $18,000 annual communications rent. Assume a reviewed scenario gives the buyer that full rent and $3,000 of distinct annual site obligations not already in the STR stack.
| Illustrative case | Separate communications balance | Combined annual owner cash |
|---|---|---|
| Supported full rent entitlement | $18,000 − $3,000 = $15,000 | $8,000 + $15,000 = $23,000 |
| No conveyed rent; same buyer obligations remain | $0 − $3,000 = −$3,000 | $8,000 − $3,000 = $5,000 |
| Difference in the annual cases | $18,000 less incoming rent | $18,000 less combined cash |
The second case is an assumed document outcome for sensitivity, not a rule that every buyout leaves these obligations with the buyer. Replace both entitlement and costs with professional conclusions. If another party bears the $3,000, revise that input. If it is already included in STR expenses, do not subtract it again. A historical lump-sum buyout paid to the seller contributes zero new buyer cash in this example unless a separately verified transaction term says otherwise.
Now separate payment timing from entitlement. If two $1,500 monthly payments are delayed during payee setup, $3,000 of expected near-term receipts is unavailable. That is not automatically $3,000 of permanently lost annual income or a payment guarantee. Identify who holds the funds and whether and when the buyer can obtain them. Fund bills without depending on an unresolved reconciliation.
Illustrative early budget: $130,000 purchase/closing cash plus $40,000 distinct setup plus $30,000 retained liquidity totals $200,000. With $220,000 available, $20,000 remains outside the plan. The reserve is retained cash, not an expense or income. A separate $3,000 early cash need while expected payments are delayed reduces outside-plan flexibility to $17,000 if funded there; do not add the same obligation to setup or carry twice. This is a timing sensitivity, not a reason to capitalize unsupported rent into the offer.
Approve the acquisition only with a documented handoff
Compare the base STR without unsupported communications rent with at least one alternative property. If the acquisition is acceptable only at the $23,000 combined cash level, unresolved entitlement is decisive rather than a minor postclosing task. Ask counsel about valid conditions, deadlines and remedies before protections expire. A lower price cannot create a missing legal right, release a conflicting site right or force an operator to accept incomplete documents.
Proceed when the conveyed rights, sale conditions, responsibility scope, financing and conservative cash plan are understood and acceptable. Reprice a confirmed economic difference through valid terms. Delay within adequate protection when a governing agreement or operator response is missing. Decline a plan that needs unsupported rent, future payment setup or an assumed income-tax benefit to fund purchase and launch.
Prepare a bounded closing memo: site identifier, rights holders, documents reviewed, required sale steps, accepted entitlement, expected payee-change status, dated receipts and responsibilities. Assign an owner to confirm the actual first correctly directed payment after closing without treating that later task as permission to skip pre-purchase verification. Use the all-in budget and high-income buyer roadmap for the rest of the acquisition.

Frequently asked questions
Does buying the land automatically establish my right to cell-tower rent?
Do not assume so. Have counsel reconcile the lease, amendments, assignments, buyout documents and proposed conveyance to identify the actual rent entitlement.
Does a payee-change form prove the rent rights were conveyed?
No. Payment administration and legal entitlement are separate review questions. Obtain the required conveyance evidence and operator-specific handoff instructions.
Can communications rent automatically help qualify for an STR mortgage?
No. The actual lender must review the rights, payment evidence, collateral and loan program. Supported rent does not guarantee recognition or approval.
Should delayed setup payments be treated as permanently lost income?
Not automatically. Separate entitlement, timing, collection and reconciliation. Fund near-term bills independently while the actual payment status is unresolved.
