Acquisition Diligence

Can you buy a tenant-occupied property and turn it into an STR?

You may be able to buy a tenant-occupied property and operate it later as a short-term rental, but the purchase does not itself give you immediate vacant possession or STR permission. Obtain the full tenancy record, have a local attorney confirm when and how possession could legally be delivered, and verify the address-specific hosting rules before you make an offer. Underwrite the property as a long-term rental until the earliest legally supportable conversion date, then add furnishing, launch costs, and a delay case. If the deal only works on STR income that cannot start yet, the attractive asking price may not be enough.

Make possession an acquisition gate, not an assumption

Request the signed lease and every amendment, renewal, side letter, payment ledger, deposit record, prepaid rent record, and any notices or disputes. Ask who occupies the property, when the current term ends, whether renewal or purchase options exist, and what the seller has promised the tenant outside the written lease. A buyer should not rely on a listing remark that says 'vacant at closing' without a contract term, evidence, and a remedy reviewed by local counsel. Do not pressure a tenant or presume a lawful tenancy ends merely because title changes.

Considering an occupied property because it appears cheaper than a guest-ready STR? Book a BNB Accelerator acquisition call to compare the legally supportable opening date and all-in basis before you offer.

Tenancy rules vary materially by jurisdiction. As one example, the New York Attorney General's tenant-rights guide describes obligations when a building is sold, including the handling of security deposits. That is New York guidance, not a national rule or a timetable for your deal. Have an attorney in the property's jurisdiction review the actual lease, local law, notices, deposit transfer, and any vacancy condition. A signed move-out agreement, when lawful, needs its own verification and timing analysis.

Check whether the eventual STR use is legal and financeable

Confirm zoning, STR registration or licensing, occupancy limits, HOA or covenant restrictions, parking, and any ownership-change conditions with the applicable authority and documents. The long-term tenancy may be lawful while nightly rental at the same address is not. Do not pay an STR premium for a property whose only proven use today is a conventional lease. Start with the permit-transfer guide, then get a current answer for the parcel.

Tell the lender the actual intended investment use and that an existing tenant will remain after closing. Ask whether the lender will qualify using the current lease, what documentation is required, how it treats later STR conversion, and whether property insurance and occupancy fit the loan terms. Fannie Mae's current rental-income guide identifies purchases with an existing lease that transfers to the borrower as a specific documentation scenario. That does not mean the tenant's rent or a future Airbnb projection automatically qualifies you for every loan. Obtain a lender-specific answer before removing a financing contingency.

Compare the rent-to-STR bridge with a vacant alternative

Build a monthly bridge from closing through the first legal guest stay. Include tenant rent actually collectible, debt service, taxes, insurance, utilities the owner pays, maintenance, any lawfully agreed relocation cost, vacant-period carrying, repairs after possession, furnishing, permit work, photography, and launch ramp. The purchase budget must leave cash for this bridge as well as lender-required reserves. Use the cash-needed framework and downside model rather than applying stabilized annual STR income to day one.

Illustrative only: an occupied house costs $400,000 and a comparable vacant candidate costs $430,000. If the occupied deal requires $18,000 of extra carrying and conversion costs plus $22,000 in furnishing and repairs not needed by the alternative, its apparent $30,000 price advantage becomes a $10,000 higher all-in basis before financing, taxes, different demand, or delay risk. These are invented figures to show the decision math, not market prices or results. If possession slips one additional quarter, recalculate both cash need and the season in which the first booking would occur.

Do not assume the current tenant will become an STR manager, agree to early departure, or permit invasive pre-closing work. If the seller promises vacancy, put the condition and acceptable evidence into the purchase agreement through counsel. If the buyer will inherit the lease, price the property as a leased investment during that period and treat STR conversion as a later option, not guaranteed near-term revenue.

Proceed, renegotiate, delay, or reject before the offer hardens

Proceed when the lease and local rules are reviewed, possession timing is legally supportable, the STR path is documented, the lender accepts the actual use, and both the lease-period and STR-period downside cases meet your cash limits. Renegotiate if the tenancy extends longer than advertised, deposits or repairs change the basis, or the conversion misses a demand season. Delay if material lease terms, local permission, or the lender's property review remain unresolved inside the contingency window.

Reject a deal that requires ignoring tenant rights, misstating occupancy to a lender, assuming an unissued permit, or promising a first booking date you cannot control. Compare at least one vacant and one operating STR alternative before deciding that a tenant-occupied discount compensates you for lost time and execution work. Book a call to compare the occupied property with other purchase-ready STR candidates. BNB Accelerator cannot guarantee vacant possession, permits, financing, income, or returns. Frequently asked questions

Can I start Airbnb bookings immediately after buying a tenant-occupied house?

Do not assume so. Confirm the tenant's lawful possession rights, the date the home can be delivered vacant, local STR permission, insurance, and time needed to furnish and launch.

Does the tenant's lease disappear when the home is sold?

Do not rely on that assumption. The result depends on the lease and local law. Have a local attorney review the tenancy and sale terms before making an STR offer.

Can existing long-term rent help qualify for the purchase loan?

Possibly under the lender's program and documentation rules. Fannie Mae addresses purchases with an existing lease that transfers, but the lender must evaluate your actual file and intended use.

How do I price a tenant-occupied STR candidate?

Underwrite current lease cash flow until a legally supportable conversion date, then include vacancy, repairs, furnishing, permits, launch ramp, reserves, and a delay case before setting a maximum offer.

Questions to resolve before committing to this purchase

How do I review tenant leases before an STR purchase?

Request all authorized leases, amendments and relevant notices for counsel's review. A seller's plan for vacancy does not establish the buyer can begin short stays.

How do I verify tenant deposit allocation at settlement?

Have the closing team identify deposit amounts and required treatment under the transaction and applicable law. Reconcile the actual allocation rather than assuming seller cash is buyer income.

How do I condition an STR purchase on lawful vacant possession?

Ask counsel to define possession evidence, deadlines and remedies. Do not assume a sale terminates occupancy rights or authorize guest bookings based on a promised move-out.

How do I budget an STR purchase with delayed vacancy?

Model the lawful existing use and separate the timing and cost of any permitted change. Exclude short-stay revenue until possession and rental permission are established.

How do I compare occupied property value with STR conversion risk?

Price the current legal use independently from the proposed conversion. If the investment needs unsupported vacancy timing, identify that dependency before committing purchase capital.

Record the evidence, responsible reviewer, cash effect and transaction deadline for any unresolved item. Bring those findings to the STR acquisition call before deciding whether to proceed, revise the offer or exercise available contract protection.
