Before committing capital, answer this question for the actual address: Is legal short-term-rental use verifiable? The method is to check the exact parcel and ownership structure with the local authority; record permit, cap, inspection, tax and renewal requirements.
Make the decision before the deposit is at risk
Search rules at the jurisdiction, parcel, unit and owner level. Record caps, renewals, inspections, tax accounts and whether an existing permit survives sale. A currently operating neighbor proves little about the buyer's address. Underwrite the allowed alternative use if the permit is denied or delayed, and align the contract with that result.
What changes for this property
A new home has limited operating history, so the pro forma must come from independent comparables. Completion, certificate of occupancy, punch-list work and permit issuance can all delay the first booking. Confirm which warranty claims are handled promptly enough for a guest operation. A lender's rate lock or appraisal timing may expire before the property is ready.
The revenue case should forecast from operating comparables, not a seller's untested pro forma. Record the source, the period covered and any owner-blocked nights beside the forecast.

Operating exposure to price: New vendor setup and warranty response. Identify the vendor, fee, start date and backup for each required task. Those costs affect the underwriting and the date of the first rentable night.
Decision rule for the buyer
Treat uncertain legal use as a purchase condition, not post-close homework. Also test the exit: first-year actuals may lag a stabilized resale story. A business owner should decide whether the property still fits when attention is focused on the primary business; a real estate investor should compare the same capital with the next available deal on a consistent after-reserve basis.
