Acquisition Financing

Can you buy a short-term rental after bankruptcy?

Possibly, but rebuilt savings and a promising Airbnb listing do not establish that your purchase loan is eligible. Have the lender review the bankruptcy resolution documents, other credit events, intended investment use and proposed closing date before you offer. Then evaluate the STR using financing you can actually obtain and enough cash to open safely. Book a call to screen STR purchases within your lender-confirmed post-bankruptcy budget.

Get a purchase-specific answer, not a homebuyer waiting-period headline

Tell the lender that you intend to buy an investment property for short-term renting. Ask which product it would use, whether it accepts that use and your credit-event history, what conditions remain, and which date determines eligibility. A principal-residence program, an online calculator or a quote issued before document review does not answer this STR purchase question. BNB Accelerator can help coordinate property selection and diligence; the lender alone determines its approval.

For an agency reference, Fannie Mae's credit-event guidance lists four years from discharge or dismissal for Chapter 7/11; Chapter 13 distinguishes two years from discharge from four years from dismissal. Documented extenuating exceptions and multiple-filing rules require separate review. Meeting a waiting period does not remove credit and underwriting requirements. Ask your lender how these provisions, its overlays and the complete record apply; do not calculate approval from the filing date.

The same guidance limits its shortened foreclosure exception: investment-property purchases are not permitted until seven years have elapsed. It also addresses a mortgage discharged in bankruptcy, where appropriate evidence can affect which waiting period applies. Do not transplant a primary-home foreclosure exception to an STR or automatically add separate clocks. Have the lender reconcile the actual documents. This is not a bankruptcy-law opinion or a universal rule for all investment loans.

Build the credit-event register before setting a closing calendar

Prepare a compact register for the lender rather than sending a remembered timeline to your agent. Use court or creditor records for the actual event and resolution, and let the lender specify any additional evidence it needs. Distinguish filed, discharged, dismissed and still pending. If the case remains active, involve your bankruptcy counsel before making commitments; this page does not establish your authority to borrow or acquire property.

Illustrative timing exercise, not an eligibility determination: a buyer remembers filing in June 2022, but the Chapter 7 resolution order is dated December 15, 2022. For a lender applying the referenced four-year requirement without an exception, December 15, 2026 is the anniversary to review—not June 2026. A proposed October closing therefore needs a different documented answer or a changed schedule. Ask which underwriting milestone governs the date in this file; the illustration is not a promise that a December contract will fund.

Place document review before offers, the lender's remaining conditions before the financing-protection deadline, and confirmed eligibility timing before settlement commitments. Ask your agent and counsel to explain the actual contract's termination or extension options. A seller's willingness to wait is not a signed extension. Do not make nonrefundable furnishing orders to preserve an opening date while the loan path remains unresolved. See the STR acquisition-to-opening timeline for the separate possession and launch dependencies.

Evaluate an alternative lender without assuming DSCR ignores bankruptcy

A property-income loan may be worth investigating, but a DSCR label is not a waiver of credit-event review. Lendmire's current post-bankruptcy guide expressly discusses STR financing and says seasoning varies by lender and chapter. It is a broker's description, not a commitment for your borrower or address. Obtain current written terms and conditions; do not turn a provider's general availability statement into guaranteed approval or a universal minimum wait.

Ask the proposed lender for the accepted event date, evidence needed, investment STR and first-time-investor eligibility, down payment, reserves, all-in payment, points, prepayment terms and realistic closing timetable. Confirm how it will establish this property's eligible rent. Seller gross revenue and your proposed nightly rate are not automatically the lender's accepted income. Compare paths using the same property assumptions and truthful intended occupancy.

Include the ownership and signer structure in the request. An LLC should not be treated as a way to hide a member's history or avoid disclosure. See the personal-guarantee purchase guide for reviewing recourse separately. Reject a plan that depends on misrepresenting occupancy, leaving out a credit event or borrowing from a provider that has not accepted the actual file.

Test the cash cost of buying now without relying on a later refinance

Illustrative only: assume $200,000 of usable purchase cash and a $500,000 STR. A hypothetical path needing 30% down uses $150,000 before closing. Add $20,000 of closing costs and $30,000 to prepare and furnish; nothing remains from those funds for opening delays or operating downside. If your independent cash plan calls for $30,000 retained, the purchase has a $30,000 gap even if the lender approves. These figures are not current lender terms, recommended reserves or a predicted return.

A separate hypothetical path needing 20% down and $15,000 closing costs would leave $55,000 after the same $30,000 launch spend. The $55,000 difference identifies what to investigate; it does not establish that lower-cash financing is available now or will exist after a waiting period. Request actual quotes, account for reserve eligibility and lender conditions, and screen properties against the financing available on your intended purchase date.

Do not fix the first case by assuming next year's refinancing will return the missing cash. Future credit, valuation, rent evidence, program availability and costs are unknown. The available loan must work through a conservative holding period without a promised replacement. Compare a lower-priced property, additional independently acceptable funds or delaying the purchase. The purchase-and-launch calculator organizes spending, while the downside underwriting framework tests the property after financing.

Preserve household and recovery liquidity as well as STR cash. Do not treat buying an Airbnb as a required step in rebuilding finances. A lender's willingness to fund the transaction is not a finding that another leveraged asset is suitable for you. Obtain independent financial advice and evaluate address-specific legal STR use, seller evidence, insurance and launch needs regardless of the credit history.

Proceed only when the date, product and property all work

Proceed when the lender has reviewed the complete history and confirmed a viable investment-STR path for the closing, conditions are achievable within contract protections, and the property passes independent acquisition diligence with adequate retained cash. Renegotiate price or timing if verified loan terms create a cash gap or eligibility-date conflict. Delay while resolution evidence, counsel review or financing conditions remain unresolved. Reject a deal that only works through undisclosed history, unsupported reservations or a guaranteed future refinance.

Bring the lender-confirmed search ceiling and earliest realistic closing window to your acquisition team; share sensitive court and financial documents with the appropriate professionals through secure channels rather than publicly posting them. Book a call to compare STR candidates against your verified post-bankruptcy financing and cash plan. The acquisition question is which property, if any, deserves an offer under your actual available terms—not whether a marketing page says buyers can start again.

Frequently asked questions

Can I buy an Airbnb investment property after bankruptcy?

Possibly. Obtain lender review of the actual resolution documents, complete credit history, intended rental use and purchase timing. Then verify that the property and complete opening cash plan work under an available loan.

Should I measure my waiting period from the filing date?

Do not assume so. Give the lender the actual case and resolution records and ask which event date and transaction milestone govern its product.

Does a DSCR loan ignore my bankruptcy?

No such conclusion follows from the label. Lenders can review borrower credit events and impose their own seasoning and other conditions even when property income drives qualification.

Should I buy now and plan to refinance when my history improves?

Do not make viability depend on a future refinance. It may be unavailable or costly. Evaluate the obtainable purchase loan and retained liquidity without assuming replacement financing.
